What is MLC 2006?

The MLC is a comprehensive international employment Convention adopted by the ILO International Labour Conference in February 2006

ILO is represented in over 130 countries

Who is covered by the MLC 2006?

It applies to all seafarers that is all persons employed or engaged or working in any capacity on board a ship to which the Convention applies

Includes crew navigating or operating the ship, cadets, hotel personnel and others

Why is MLC 2006 important?

For Two Reasons:

(A) Requirement of minimum wages

1. Guideline B2.2.4 states the seafarers wages must be minimumas set by Joint Maritime Commission for the position of an AB seaman per month

2. ITF & ISF have agreed on an minimum interpretation for all positions

(B) Requirement of CBA

1. MLC uses the term SEA(Seaman's Employment Agreement) which includes:

  • Articles of Agreement
  • Contract of Employment
  • Provisions of an applicable CBA

2. CBA details all the terms and conditions of crew employed on the ship

3. It specifies entitlements such as wages, working hours, repatriation, compensation, and so on.
